Myanmar: foreign investment rules issued

On 31 January 2013, the Ministry of National Planning and Economic Development issued foreign investment rules (FIR) via Notification No. 1/2013.

The FIR provides additional details and guidance on the Foreign Investment Law of 2012 (FIL).

Briefly, the FIR includes guidance on:

  • Business classifications
  • Various terms and conditions for foreigners investing in Myanmar
  • Transfer of shares in entities formed under the FIL between Myanmar citizens and foreign nationals, and vice versa. Such transfers, however, require pre-approval from the Myanmar Investment Commission, which is granted at their discretion
  • The role of the Directorate of Investment and Companies Administration with regard to foreign investments in Myanmar
